城市土地的管理在当今中国是一个待研究和解决的重大课题,在特区也不例外。深圳经济特区一成立就实行土地所有权与使用权分离、有偿使用土地的土地管理体制,对于节约用地,促进城市的迅速形成,创造良好的投资环境,提高城市开发建设的经济效益,起了积极的作用。但从总体上来看,特区的土地管理仍十分落后,还没有形成完善的管理体系。土地管理机构不健全,法制不完备,政策不明确,管理脱节,在一定程度上阻碍了特区投资环境的进一步改善,不利于特区外向型经济的迅速形成和发展。总结几年来特区土地管理的经验教训,改革和完善特区现行的土地管理体制,是摆在我们面前的一项紧迫任务。本文拟从特区土地管理的基本原则和方法这两个方面,探讨特区土地管理的总体模式。
The management of urban land in China today is a major issue to be studied and solved, and the SAR is no exception. The establishment of the Shenzhen Special Economic Zone on the implementation of the land ownership and the right to use separation of land use compensation for the use of land management system for the conservation of land to promote the rapid formation of the city to create a good investment environment and improve the economic benefits of urban development and construction has played a positive effect. However, on the whole, the land administration in the SAR is still lagging behind and no sound management system has yet been formed. Lack of sound land management structure, incomplete legal system, unclear policies and out-of-step management have hindered further improvement of the investment environment in the SEZ to a certain extent, which is not conducive to the rapid formation and development of the export-oriented economy in the SEZ. Summing up the experiences and lessons learned from land administration in the SAR in recent years and reforming and improving the existing land administration system in the SAR, it is an urgent task for us to face. This article intends to explore the general pattern of land administration in the SAR from the two aspects of the basic principles and methods of land administration in the SAR.
