在施工合同的履行过程中,由于工程各方目标的不同和项目管理水平的差异,工程争议不可避免。而争议的解决将消耗各方的资金、时间及各种资源。如何将这种消耗降到最低,是项目管理人员应该思考的问题。对国内外建设工程争议评审制度现状进行研究,从交易成本的理论出发,对我国正在尝试实施的建设工程争议评审制度进行研究,并在此基础上提出完善措施。
During the performance of the construction contract, project disputes are inevitable because of the differences in the objectives of the parties and the differences in project management. The resolution of the dispute will consume all parties’ funds, time and various resources. How to minimize this kind of consumption is a problem that project managers should think about. The status quo of domestic and international construction project dispute review systems is studied. Based on the theory of transaction costs, the review of the construction engineering disputes review system that China is trying to implement is studied, and on this basis, improvements are proposed.
