足球俱乐部通常在与球员的雇佣合同中插入单边延期选择条款,赋予俱乐部单边延期或取消合同的权利。大量案例表明,国际足联对于仅有利于俱乐部的单边延期选择条款通常认定为无效。为了减少与各国国内法的冲突,国际足联逐渐放宽了标准,将合同的延展期限、选择权行使的告知时间、薪水报酬、双方当事人的地位以及选择权条款在原始合同中的表述这5个因素作为确定该条款是否有效的标准。在我国,对于单边延期选择条款效力的认定,应当在符合《劳动合同法》的公平原则、平等原则以及合同自由原则的前提下,采取与国际足联相一致的做法,以促进国际足球世界争议解决制度的协调与统一。
