我国是一个具有五千多年文明,且历史悠久、文化灿烂的多民族的国家,民间艺术源远流长、丰富多彩。优秀的民间艺术作品含量之大,世所罕见,诸如河北的杨柳青年画、湖北的大冶木雕、荆州皮影、云南的傣族织锦、大理石窟造型、纳西古乐、东巴舞蹈、白沙壁画、民族服饰以及牛郎织女、梁祝姻缘、孟姜女、白蛇传等民间故事,等等。充分展示了我国古代劳动人民的勤劳、勇敢和智慧,是我国宝贵的文化遗产,这些民间艺术作品不仅具有巨大的文学艺术价值,更是中华民族发展史的缩影。以法律形式保护民间艺术不仅关系到整个国家的利益,而且也关系到创作群体的利益,因此,为民间艺术提供有效的法律保护是非常必要的。
