在现实中,作为管理者的电子商务平台也会与会员发生各类纠纷。比如说电子商务平台以格式条款减轻自身责任,自律管理不当给会员带来经济损失以及处罚不当给会员带来财产损失等。其中,目前最引人关注的是电子商务平台对会员信息的保护问题。一方面此类问题并不属于电商平台自律管理的范围,另一方面电商平台作为营利性的企业组织,在涉及其自身利益时,其自律管理必然会失效,从而为电子商务交易带来风险。因此针对该电子商务交易中的监管漏洞,电商平台的自律管理有必要接受行政监管。另外,值得一提的是,IOSCO早在2000年《有效的监管模式》的专题报告中就有过的此类表述:“有效的自律管理,必须置放于政府监管之下,政府监管是自律管理机制中的基本要素(1)”。
