近几十年来,加重承运人的责任成为国际趋势,例如在海事审判中,承运人越来越难援引航海过失免责条款。《鹿特丹规则》已在2009年9月开始开放签署,截止到2010年4月1日,已经有21个国家签署了该公约,但目前还没有国家提交批准书、接受书或核准书。虽然签字不等于批准和生效,但可以表明一国对《鹿特丹规则》的态度。不管我国是否加入《鹿特丹规则》,规则都会对我国造成一定程度的影响。本文对此试作一定分析。
In recent decades, it has become an international trend to aggravate the responsibility of carriers. For example, in maritime trials, it has become increasingly difficult for carriers to invoke the exemption of nautical negligence. The Rotterdam Rules were open for signature in September 2009, and as of April 1, 2010, 21 countries have signed the Convention, but no country has yet to submit an instrument of ratification, acceptance or approval. Although signing does not amount to ratification and entry into force, it can indicate a country’s attitude towards the Rotterdam Rules. Whether or not our country accedes to the Rotterdam Rules, the rules will have a certain degree of impact on our country. This paper attempts to make a certain analysis.
