第一条 为加强商品住宅质量管理,确保商品住宅售后服务质量和水平,维护商品住宅消费者的合法权益,制定本规定。 第二条 本规定适用于房地产开发企业出售的商品住宅。 第三条 房地产开发企业在向用户交付销售的新建商品住宅时,必须提供《住宅质量保证书》和《住宅使用说明书》。《住宅质量保证书》可以作为商品房购销合同的补充约定。 第四条 《住宅质量保证书》是房地产开发企业对销售的商品住宅承担
Article 1 These Provisions are formulated to strengthen the quality management of commercial houses, ensure the quality and level of after-sales service of commercial houses, and safeguard the legitimate rights and interests of consumers of commercial buildings. Article 2 These Provisions shall apply to commercial houses sold by real estate development enterprises. Article 3 When a real estate development enterprise delivers newly-built commercial residential buildings for sale to its users, it shall provide “Residential Quality Assurance Certificate” and “Residential Usage Instruction Manual”. “Residential Quality Assurance” can be used as commercial real estate purchase and sale contract supplementary agreement.
