相对不起诉制度在法律上的确立 ,顺应了国际刑事诉讼的发展趋势。在我国它适用于犯罪情节轻微 ,以及不需要判处刑罚或者免除刑罚的情形。司法实践中 ,相对不起诉制度还存在着适用力度不够大、被不起诉人的权利缺乏保障等问题 ,需要进一步加强和完善 ,以维护社会的稳定
The relative non-prosecution system is legally established and complies with the development trend of international criminal procedure. In our country it applies to minor crime cases, and do not need to sentence or exempt from punishment. In judicial practice, the relative non-prosecution system still has some problems such as insufficient application of force and lack of protection of the rights of non-prosecutors, which needs to be further strengthened and perfected in order to maintain social stability
