高圣平先生的《宅基地转让纠纷个案的法律经济学》一文,引用并分析了沈阳市东陵区和重庆市武隆县两个宅基地转让的案例。前案例的二审法院沈阳市中级人民法院认为:在本案中,原被告签订的《住宅用地交易协议书》系双方当事人真实意思表示,不违反法律、行政法规的强制性规定,合法有效。后案例的一审法院重庆市武隆县人民法院则认为,宅基地使用权专属于农村集体经济组织成员享有,城镇居民和国家公务员不能享有宅基地使用权。本
Mr. Gao Shengping's article “Law Economics of Cases of Dispute over Homesteads” cited and analyzed the cases of the transfer of two sites in Dongling District of Shenyang City and Wulong County of Chongqing Municipality. The second instance court of the former case, Shenyang Intermediate People's Court, held that in the present case, the “agreement for the transaction of residential land” signed by the original defendant stated that the parties did not violate the mandatory provisions of laws and administrative regulations and is lawful and valid. The court of first instance in the latter case, Wulong County People's Court in Chongqing, held that the right to use house sites was exclusively enjoyed by members of rural collective economic organizations. Urban residents and state civil servants could not enjoy the right to use house sites. this
