本文从法学的角度,探讨了传播权作为一个法律概念建立的必要性、合理性和可能性。认为新媒体尤其是自媒体(we media)导致传统的传播关系发生了实质性改变,受众不再被动。新型社会关系的出现必然要求建立传播权这一法律概念,信息网络传播权(著作权)、知情权、表达权等已有概念无法代替传播权的概念。言论出版自由等宪法权利在我国的实现还存在很多制度性的障碍,还是一种比较抽象的权利,通过下位概念“传播权”的提出能有效促进言论出版自由的实现。传播权在国际公约里是一种人权,是自由的完整实现中的重要一环。我国的政治传统、文化传统、法治传统等都深刻制约着传播权的设立和实现,因此传播权作为法律概念的形成任重而道远。
This article explores the necessity, rationality and possibility of the right of communication as a legal concept from the perspective of law. It is believed that the new media, especially the media, has caused a substantial change in the traditional communication relations, and the audiences are no longer passive. The emergence of new social relations inevitably requires the establishment of the notion that the concept of communication, which is the legal concept, the right to information dissemination (copyright), the right to information and the right to express, can not substitute for the right of communication. There are still many institutional obstacles to the realization of constitutional rights such as freedom of speech and publication in our country. Or is it an abstract right that can effectively promote the realization of freedom of speech and press through the proposition of the subordinate concept of “right of communication”. The right to communication is a human right in international conventions and an important part of the complete realization of freedom. The political traditions, cultural traditions and traditions of the rule of law in our country strongly constrain the establishment and realization of the right to communication. Therefore, the formation of the concept of communication as a legal task has a long way to go.
