在当今的国际贸易中,信用证是普遍采用的付款方式之一。虽然有资料表明,在欧美等发达国家,信用证的使用频率有所减少,但在发展中国家,尤其是东南亚地区,信用证的使用量仍在逐年提高。在我国,信用证作为一种支付方式,被广泛应用于对外贸易中。因此所产生的纠纷也在不断增加。尽管国际商会的《跟单信用证统一规则》(UCP)已为我国银行所采纳,其业务操作多遵循UCP的相关规则,但我国法律对于如何适用UCP500,以及如何处理UCP没有涉及的法律问题,仍存在许多不明确之处。
