1995年2月1日开始施行的《中华人民共和国广告法》又为广大消费者指出了一条投诉之路,那就是除追究经营者责任之外,还可追究虚假广告的广告经营者、广告发布者、社会团体或者其他组织的连带责任。 所谓连带责任,是指由连带债务或共同侵权行为而产生的民事责任。《广告法》规定虚假广告的连带责任,是由广告活动主体的法定义务和侵权行为责任决定的。《广告法》规定的广告活动的主体,包括广告主、广告经营者和广告发布者。其中广告主是指为推销商品或者提供服务,自行或者委托他人设计、制作、发布广告的法人、其他经济组织或个人。广告经营者,是指受委托提供广告设计、制作、代理服务的法人、其他经济组织或个人。广告发布者,是指为广告主或者广告主委托的广告经营者发布广告的法
