从刑法的基本原则来看,罪刑法定原则是刑法最具代表性的基本原则。根据这一原则,凡是刑法明确规定为犯罪的行为,均应当定罪处刑。但在近年的司法实践当中,在满足一定条件的情况下,对特定犯罪行为进行非犯罪化处理已经成为司法机关处理案件的常规机制,也即本文所论及的条件性出罪机制。在恶意透支型信用卡诈骗犯罪案件的司法实践中,条件性出罪机制已经得到一定的实践应用,相关司法解释从多个角度对恶意透支型信用卡诈骗罪规定了出罪条款。正是基于条件性出罪机制这一基本原理,力图在恶意透支型信用卡诈骗案件的司法实践中构建一个有条件的、系统的出罪路径体系。
Judging from the basic principles of criminal law, the principle of legality of crimes and punishments is the most representative basic principle of criminal law. According to this principle, anyone who explicitly stipulates as a criminal act in criminal law should be convicted and sentenced. However, in recent judicial practice, under some conditions, the non-criminal handling of certain criminal acts has become a regular mechanism for the judicial organs to handle cases, that is, the conditional offensive mechanism discussed in this article. In the judicial practice of criminal cases of malicious overdraft credit card fraud, the conditional crime mechanism has been applied in practice. The relevant judicial interpretation provides the articles of guilty plea for malicious overdraft credit card fraud from multiple perspectives. It is based on the basic principle of the conditional offender mechanism that seeks to establish a conditional and systematic system of criminal offenses in the judicial practice of malicious overdraft credit card fraud cases.
