“一带一路”战略的实施促使中国由传统的资本输入大国向资本输出大国转变,出现了投资东道国和投资母国双重身份混同的局面。无论是主动提起还是被动应诉,我国已经开启了对ICSID机制的参与和运用,同时面临着在全面参与ICSID机制中由“主动提起”增多和ICSID管辖权扩大适用所带来的双重挑战。应对挑战,应当及时总结我国参与ICSID机制的实例经验,审视ICSID管辖权被扩大适用的具体规则,重视BIT与争端解决机制的关联并加以完善;熟悉并适应ICSID规则,运用更加灵活的方式解决投资争端;推动ICSID规则的改革,完善我国现有投资法律体系。
The implementation of the “Belt and Road” strategy has prompted China to shift from the traditional capital-importing major powers to the major capital-exporting countries, resulting in a double-faceted investment mix between the host and investor countries. China has already started the participation and application of ICSID mechanism both at the initiative and indifferently. At the same time, it faces the double challenge brought by the increase of “initiative filed ” and the enlargement and application of ICSID jurisdiction in full participation in ICSID mechanism . In response to the challenge, we should summarize our country’s experience in participating in the ICSID mechanism in time, review the specific rules on the expanded and applicable ICSID jurisdiction, attach importance to and improve the association between BIT and the dispute settlement mechanism, familiarize with and adapt to the ICSID rules and apply more flexible solutions to investment Dispute; promote ICSID rules reform, improve our existing investment law system.
