优先购买权的法律性质和优先购买权的法律效力,此二者是优先购买权最为核心的问题。法释(2009)11号出台后,合乎法律意旨地解释房屋承租人优先购买权的法律性质和法律效力,对于法律适用意义重大。房屋承租人优先购买权为附条件的形成权,仅具有债权性效力。法释(2009)11号第21条的类推适用需要谨慎。
The legal nature of the preemptive right and the legal effect of the preemptive right, both of which are the core issues of the preemptive right.
