企业的自由度和政府的干预度是美国反垄断法的核心矛盾。从谢尔曼法开始,美国反垄断法走过了扩大政府权力、积极干预经济运行与抑制公共权力、宽容企业自由的风雨历程。在今天经济全球化背景下,以效率为主要目标的反垄断执法活动仍然身置于自由民主的困境之中。
The degree of freedom of enterprises and government intervention are the core contradictions of the U.S. antitrust law. Starting from the Sherman Act, the United States antitrust laws have gone through the ups and downs of expanding government power, actively intervening in economic operations and curbing public power, and tolerating corporate freedom. Against the backdrop of economic globalization, antitrust law enforcement activities with the main objective of efficiency are still placed in a free and democratic predicament.
