本文通过论述我国法官与律师,法学理论界与实务界之间的关系,揭示了法律职业共同体在我国尚处于一个雏形阶段,加快构建法律职业共同体成为了新一轮司法改革的重点。巡回法庭作为司法改革的试验田,通过设置专门的律师法官会见室,定期举行律师代表座谈会,在裁判文书中对未采纳律师的意见进行充分说理等方式积极构建法官律师新型职业共同体。同时通过与法学院校合作设立实习生制度和校内校外双导师制创新法治人才的培养机制,为理论界和实务界搭建起常态化的交流平台。巡回法庭的上述探索一定意义上为我国法律职业共同体的构建积累了宝贵的经验。
By discussing the relationship between judges and lawyers in our country and the field of legal theory and practice, this article reveals that legal professional community is still in its embryonic stage in our country. Accelerating the construction of legal professional community has become the focus of a new round of judicial reform. As a trial field of judicial reform, Circuit Court actively constructs a new type of professional community of judges and lawyers by setting up a special meeting room for judges and lawyers, holding regular forums of lawyers, and fully handling the opinions of unaccredited lawyers in the judicial instruments. At the same time, through the establishment of internship system in cooperation with law schools and the training system of innovative double-tutor teachers both at home and abroad, the forum builds an exchange platform for both theorists and practitioners. In a certain sense, the aforesaid explorations by the Circuit Tribunal have accumulated valuable experience for the construction of the legal profession community in our country.
