我国于2012年10月对《国家赔偿法》的修订引起了法学界不小的关注。然而,作为国家赔偿重要组成部分的非刑事司法赔偿领域之完善与细化目标未能实现。针对当下赔偿法领域存在的不足和空缺,结合理论与实务的指导与需求,从非刑事司法赔偿制度之认定、非刑事司法赔偿制度之归责原则、非刑事司法赔偿制度之不足以及非刑事司法赔偿制度之完善等四个方面加以探讨和展开,以促进对“矫正正义”的“正义矫正”。 In October 2012, China’s revision of the “State Compensation Law” caught the attention of the legal science community.
