随着城镇化进程的不断推进,农村土地的用途发生了改变,释放出土地增值收益,形成了新的农地发展权。在农村的房屋拆迁的纠纷,实际上就是农地发展权增益的纠纷。致使产生纠纷的主要原因是法律不健全,在制度中存在缺陷和冲突。因此,必须明确农地发展权增益纠纷中存在的问题,找到其相应的法律救济途径。本文通过浅析农地发展权增益纠纷中存在的问题,探索农地发展权增益纠纷的法律救济途径,以确保农民的合法权益得根本性保障。
With the progress of urbanization, the use of rural land has changed, releasing the added value of land and forming a new right to farmland development. Disputes over the demolition of houses in rural areas are actually disputes over the gains from the right to development of agricultural land. The main reason that causes the dispute is that the law is imperfect and there are flaws and conflicts in the system. Therefore, it is necessary to clarify the problems existing in the dispute over the profit of the right to development of agricultural land and find out the corresponding legal remedies. This article analyzes the problems existing in the dispute of gain of development right of farmland and explores the legal remedies of gain dispute over the right of development of farmland so as to ensure that the legitimate rights and interests of farmers are fundamentally guaranteed.
