在二十世纪西方学术思潮重视语言研究的背景下,佩雷尔曼开创了新修辞学法律思想,尝试从语言的角度解释法律。同时,他引入价值判断的观念,并结合多元论,赋予了法律逻辑新的含义,在西方哲学中具有相当的影响。此外,佩雷尔曼新修辞学法律思想中强调的法律价值论可以为我国法制建设中如何体现法官的主观能动性给予理论基石与启示。
Against the background of linguistic studies focused on western academic thoughts in the twentieth century, Perelman initiated the legal thinking of new rhetoric and attempted to explain the law from a linguistic perspective. At the same time, he introduced the concept of value judgments, combined with pluralism, gave the new meaning of legal logic and had a considerable influence in western philosophy. In addition, the legal value theory emphasized by Perelman in the rhetorical legal thought of new rhetoric can provide the theoretical foundation stone and enlightenment for how to reflect the subjective initiative of judges in the legal system construction of our country.
