国际惯例是在国际交往中经过长期反复实践逐步形成的、具有确定内容的、为世人所共认共知的行为规则。这些行为规则在涉外审判实践中如何得到适用,是值得理论界和实务界探讨的问题。一、关于国际惯例的范围和性质在世界各国的立法和实践中,目前只有冲突规范的国际条约,而不存在冲突规范的国际惯例。尽管各国国内法和若干国际条约常有一些共同采用的冲突规则,但严格地说,这只能算是国际上比较普遍的实践或习惯做法,并非国际惯例。至于法律适用的一些基本原则,则是冲突规则的具体反映而已,或者是法律选择的方法,如果本国法律
