社区矫正制度已经在我国试点并取得一定的成效,社区矫正概念已经得到我国《刑法修正案(八)》的首肯。但是,由于正式的社区矫正立法尚未出台,各地自行制定的社区矫正文件又不相统一,因此,地方各级检察机关在社区矫正活动中扮演的角色不尽一致。有的基层检察机关是以帮助教育者的身份参与社区矫正活动,帮助司法行政机关教育服刑人员,有的则是以协调配合者的身份出现。笔者认为,上述检察机关的做法值得商榷。角色定位不准,难以有效发挥检察机关在社区矫正活动中应有的作用,因而有必要对检察机关在社区矫正活动中的角色定位问题进行探讨。文章拟从社区矫正的性质与检察权的功能两个方面为进路,对这一问题略陈管见,希冀能裨益于社区矫正司法。
Community correction system has been piloted in our country and achieved some success. The concept of community correction has been approved by China’s “Criminal Law Amendment (8)”. However, as formal community corrective legislation has not yet been promulgated and the self-developed community corrections documents are not unified, the procuratorial organs at local levels play different roles in community corrections. Some grass-roots procuratorates take part in helping community educators as an aid to correctional activities, helping judicial and administrative organs to educate prisoners, while others appear as coordinators. The author believes that the above procuratorial practice is debatable. It is difficult to effectively exert the due role of procuratorial organs in community corrections. Therefore, it is necessary to discuss the role of procuratorial organs in the role of community corrections. The article intends to approach the issue from the two aspects of the nature of community correction and the function of prosecutorial power, and hopes to benefit from community corrective justice.
