由于我国目前尚未有关于刑事被害人救助的统一立法,而其他相关性的政策对刑事被害人救助程序的规定均有不同。比较有代表性的是于2009年10月1日起施行的我国首部对刑事被害人救助进行地方立法的《无锡市刑事被害人特困救助条例》(以下简称无锡条例),以及2010年1月1日起施行的我国首部对刑事被害人救助进行省级地方立法的《宁夏回族自治区刑事被害人困难救助条例》(以下简称宁夏条例)。而检察机关在办理刑事被害人救助时,主要依据的是最高人民检察院于2010年12月29日第十一届检察委员会第五十二次会议通过的《检察机关执法工作基本规范(2010年版)》中第六章关于“刑事被害人救助”的内容(以下简称检察规范)。与《无锡条例》、《宁夏条例》相比,《检察规范》无论在刑事被害人救助的申请主体、申请时效、申请形式、申请受理具备的条件等等方面都存在很大不同,下文将逐一对其进行分析阐述。

Compared with the “Wuxi Ordinance” and “Ningxia Regulations”, “procuratorial norms” are very different both in terms of the main body of the application for assistance of criminal victims, the application period, the application form, the conditions for applying for acceptance and so on.
