本文认为,现代市场经济应是一种具有明确系统的规范化构架的法理型经济。我国迄今为止的经济立法依然存在滞后于市场经济发展的现实、立法内容散乱、标准不一、结构失衡、规范性和可操作性较差等明显不足。规范市场主体、市场主体行为、市场秩序、宏观调控、劳动及社会保障的法律是现代市场经济法律体系中不可或缺的组成部分,不能人为地造成民商法和经济法分离的立法格局,应当把这些法律门类按照主体平等、行为标准统一、秩序体系完整及宏观调控、社会保障的基本要求进行安排,并据此构建与社会主义市场经济相适应的现代市场经济法律体系。
This article argues that the modern market economy should be a kind of legal economy with a well-defined and standardized framework. The economic legislation so far in our country still lags behind the reality of the development of the market economy. The content of the legislation is scattered, the standards are different, the structure is unbalanced, and the standardization and operability are obviously inadequate. The law regulating the market main body, market main body act, market order, macro regulation and control, labor and social security is an indispensable part in the legal system of modern market economy, and can not artificially cause the legislative structure to separate civil and commercial law from economic law. These legal categories are arranged according to the basic requirements of equality of the subjects, unification of standards of conduct, integrity of the order system, macro-control and social security and the construction of a modern market economic legal system compatible with the socialist market economy.
