根据我国《物权法》的相关规定,我国对于机动车采取的公示原则是对抗要件主义,即交易的双方当事人只要达成了一致的意思表示,即签订了交易合同,便会发生物权变动的效果,只是未经登记,不得对抗善意第三人。我国《物权法》从实行至今已有5年了,而机动车的这一公示原则也在我们的实际生活中产生不少的问题。
