宪法虚伪主义质疑宪法的内容和效力,否定部门法在意义和效力上与宪法的关联。造成这一现象的原因在于民主科学精神的虚弱,法秩序内部实质性位阶秩序与价值体系的认识缺位,立法实施宪法概念的弱化及一致性解释不足。破除宪法虚伪主义须明确文本价值一体,重视法秩序与宪法意义体系,强调立法之于宪法的任务,依据宪法解释法律,将正义树立在实证法及其体现的精神之上。
Constitution hypocrisy questioned the content and effectiveness of the Constitution, denied the significance and effectiveness of the departmental law and the constitutional association.
