协商性刑事司法是一种新的程序主义,它强调通过对话协商、妥协和解实现刑事纠纷的有效解决。在协商性刑事司法中,正义被重新解释,即无论是司法机关还是刑事案件的其他当事人所追求的是自己需要的正义,称之为“自需正义”或者“协商正义”。对话与妥协是协商性刑事司法的基本作用机理,而程序保障则是协商性司法的制度框架,而要实现这种自需的正义需要的是刑事司法实践,而检察环节阶段进行刑事协商具有明显的优势,探索公诉权下的协商司法途径尤显重要。
Deliberative criminal justice is a new kind of proceduralism. It stresses that an effective solution to criminal disputes should be compromised through reconciliation through dialogue and consultation. In negotiated criminal justice, justice is reinterpreted. That is, whether it is the judiciary or other parties in criminal cases, the pursuit of the justice they need is called “self-necessity” or “negotiation justice.” Dialogue and compromise are the basic mechanisms of consultative criminal justice, while procedural safeguards are the institutional framework of consultative judicature. However, it is necessary to implement criminal justice practice in order to realize this kind of self-required justice. The advantages of public consultation to explore the judicial approach is particularly important.
