我国历来的行政法规都是将行政处罚权归口到相应的行政管理机关掌握,也就是说,我国以往的行政处罚权是采取分散的方式予以实施。《中华人民共和国行政处罚法》在肯定传统的行政处罚权的实施方式的同时,明确提出了关于相对集中实施行政处罚权的问题,并作了原则的规定。该法第十六条规定:“国务院或者经国务院授权的省、自治区、直辖市人民政府可以决定一个行政机关行使有关行政机关的行政处罚权,但限制人身自由的行政处罚权只能由公安机关行使。”本文试对相对集中行政处罚权进行初步探讨。
