附条件不起诉制度的适用规定是我国附条件不起诉制度发展中最复杂的一个问题,也是我国附条件不起诉制度发展中急需解决的首要问题。德国、日本的附条件不起诉制度的适用规定与我国有一定的相似性,但又有各自的特色。通过对德国、日本附条件不起诉制度的适用规定的分析与借鉴,可以进一步完善我国附条件不起诉制度,更好的发挥其节约司法资源,促使犯罪分子回归社会的作用。
The applicable provisions of conditional non-prosecution system is one of the most complicated issues in the development of conditional non-prosecution system in our country and also the most important issue to be solved urgently in the development of conditional non-prosecution system in our country. The applicable regulations of the conditional non-prosecution system in Germany and Japan have certain similarities with our country, but have their own characteristics. Through the analysis and reference of the applicable provisions of the conditional non-prosecution system in Germany and Japan, we can further improve the system of conditional non-prosecution in our country and give full play to its role of saving judicial resources and bringing criminals back to the society.
