长期以来,我国除天津、上海等部分地区的房屋和土地由同一个登记机关负责统一登记之外,其余省、市区均实行房屋和土地分开登记制度,即由土地管理部门和建设部门分别负责土地和房屋的登记。目前这种房地分开登记的制度存在着一系列的弊端,如容易导致房地产的权属不清、双重抵押、交易程序复杂和交易成本大,使房地产交易安全不能完全得到有效保障等问题。
