申诉人:北京市某经营通讯业务的高科技公司 被诉人:王某 案情简介: 被诉人王某2001年10月到公司从事研发工作,因王某从事的工作直接涉及公司的商业秘密和业务关系,且又有一定的专业特长,故公司为王某安排了较高的年薪和其他比较优厚的条件,同时与王某签订了一份《保密协议》。协议规定,王某在离开公司一年内不得在同行业的其他企业或业务与本公司有竞争关系的企业工作。作为补偿,申诉人在王某离职之日起3个月内向王某支付人民币10000元。王某不领取,公司为其办理银行储蓄。若王某违反约定在相关企业工作,须向企业支付违约金10000元。该《保密协议》同时规定,违约金的支付并不代表竞业禁止条款的无效。
