法律发展模式就是指法律发展的标准样式,它涉及到法律发展中的各种基本问题:法律发展的历史过程、动力、途径、资源,法律系统各部分之间的关系等。一个国家对其法律发展模式的选择,取决于多种因素的综合作用,这些因素既包括国内因素,如自然条件、经济发展水平、政治制度、文化传统等,也包括国际因素,如国际形势。
The legal development model refers to the standard style of legal development. It refers to various basic issues in the development of law: the historical process, motivation, channels, resources and the relationships among different parts of the legal system. The choice of a country’s legal development model depends on the combined effect of many factors, including domestic factors such as natural conditions, economic development, political system and cultural traditions as well as international factors such as the international situation.
