本文在简要的介绍了我国专利制度的立法及修改历程后,对第三次修订涉及的条款及其内容进行概要的说明,其中对第一章总则和第六章专利实施的强制许可制度的主要内容进行了详细的论述。文中着重比较了专利法修订前后关于授予发明和实用新型专利权的新颖性和创造性的判断标准,并详细介绍了外观设计专利制度修改的有关保护客体、申请要件、授予专利权实质性条件和专利权评价报告制度等内容。
