2012年12月28日,全国人大常委会通过了《关于修改<中华人民共和国劳动合同法>的决定》,并自2013年7月1日起施行。并且,为了贯彻落实劳动合同法修正案,人力资源社会保障部研究起草了《劳务派遣若干规定(征求意见稿)》,目前,意见征求工作已经结束,《劳务派遣若干规定》也将正式出台。劳务派遣这种用工形式在工程建设领域较为普遍,对不少施工企业来说,已成为弥补周期性、季节性用工缺口的重要途径。此次劳动合同法修正案直指劳务派遣,意在通过相关法规的进一步完善,提高劳务派遣经营的准入门槛,治理乱象丛生的劳务派遣市
