在当代信息化社会,数据库的地位越来越重要,和其他任何知识产权产品一样,数据库产品同样需要法律予以保护。对数据库进行保护的方式主要有三种,即版权法保护、反不正当竞争法保护、特殊权利保护。中国当前主要采取版权法与反不正当竞争法相结合的保护方式,但已越来越不能适应形势的发展,修改现行著作权法,并制订单独的《数据库保护法》已成为当前立法工作的当务之急。
In the modern information society, the status of the database is more and more important. Like any other intellectual property product, the database product also needs the law to be protected. There are three main ways to protect the database: protection of copyright law, protection against unfair competition law and protection of special rights. At present, China mainly adopts the protection method combining copyright law and unfair competition law, but it has not been able to adapt to the development of the situation more and more. Amendment of the existing copyright law and the development of a separate “Database Protection Law” have become the most urgent tasks in current legislative work.
