人们常说:第一个把少女比喻成花朵的是天才,第二个作此比喻的是庸才,第三个作这样比喻的就是蠢材。这种说法,用在解释民法保护著作权的目的与范围问题上,可谓精辟。民法保护的是创造性的表达或者描述。第二个、第三个用花朵比喻少女的人因为缺乏属于自己的表述,被人们认为是庸才、蠢材。人世间的天才毕竟是少数,芸芸众生多为平凡之辈。如果民法要求凡人每每自行创作,绝对不可重复天才们的表述,似乎强人所难。天才的创作才华既然是常人可望而不可即的,不如让他们尽情发挥自己的才能专司创作,而凡人需要之时则来援引、使用
