案例2010年7月,唐先生与开发商甲公司签订《商品房买卖合同》,约定甲公司于2011年12月31日前交付唐先生所购房屋;如果逾期,甲公司应自约定交房的最后期限的第二日起至实际交房之日止,每日按已付房价款的万分之二支付逾期交房违约金。唐先生全款购房,而直至2012年年底甲公司仍未交房。唐先生向法院起诉,要求与甲公司解除合同,返还购房款,并支付自2012年1月1日起至2012年12月30日止的逾期交房违约金。而甲公司辩称,迟延交房是由于当年雨水过多和领导视察工地停工等不可抗力造成的。此外,唐先生起诉解除合同之前并未通知公司,故无权解除合同。
Case In July 2010, Mr. Tang and Developer A Company signed the “Contract of Sale and Purchase of Commercial Housing”, which stipulated that Company A should deliver the house purchased by Mr. Tang before December 31, 2011. Company A argued that the delay in handing over the houses was caused by force majeure caused by over-rainy weather and the suspension of inspection of construction sites by leading officials. In addition, Mr. Tang did not notify the Company before suing the dissolution of the contract, so he did not have the right to rescind the contract.
