随着手机用户的增加,通过手机短信息群发的方式发布广告也日益增多。由于短信广告监管法律体系的不完善,存在着内容违法虚假等诸多问题,以及短信广告接受方式的强制性、骚扰性特点,其社会危害性也逐渐显现。如何正确裁定这一潜在且普遍的侵权行为,并对手机短信商业广告侵权的法律体系进行规范,这还是当前我国法律体系中的一项空白。本文将试从手机短信的概念和特点入手,对手机商业短信广告的合法性进行综合分析,提出一些见解和看法。
With the increase of mobile phone users, advertisements are also increasingly being published through mobile phone short message groups. Due to the imperfect legal system of SMS advertisement supervision, there are many problems such as the contents of the illegal advertisements, and the mandatory and harassment characteristics of SMS advertisement acceptance methods. The social harmfulness is also gradually emerging. How to correctly determine this potential and widespread infringement, and regulate the legal system of infringement of commercial text messages on mobile phones, is still a blank in the current legal system in China. This article will try to start from the concept and characteristics of mobile SMS, comprehensive analysis of the legality of mobile SMS advertising, and put forward some insights and views.
