阐述标准版权需要保护的意义、原因以及我国标准版权保护的状况,通过分析国外标准化组织的管理体制与标准版权保护的实际情况,结合国情,建议我国标准管理可借鉴日本“政府引导,行业协会、企业主导制定标准”的管理模式,将我国标准化行政管理部门双重职能分离,以达到保护标准版权的目的。
This paper expounds the meaning, reasons and the status of standard copyright protection in our country. By analyzing the actual situation of the management system and standard copyright protection of foreign standardization organizations, combined with the national conditions, it is suggested that China’s standard management can learn from Japan’s “government guidance, industry associations , Business-led development of standards ”management model, the standardization of China’s dual separation of administrative functions, in order to achieve the purpose of protecting the standard copyright.
