《刑法修正案(八)》明确将危险驾驶人罪。危险驾驶罪包括“追逐竞驶”和“醉酒驾驶”两种行为方式。而危险驾驶案件又多为醉 酒驾驶[1]。该危险不需要司法上的具体判断,只要行为人实施了在道路上醉酒驾驶机动车的行为,就推定其具有该类型化的紧迫危险,因此 笔者认为,可以在危险驾驶罪中针对醉酒驾驶行为完善结果犯和结果加重犯的形态,使其同时包含醉酒驾驶的危险犯、结果犯和结果加重犯 的情形[2],本团队曾代理过多起危险驾驶罪,现就该罪浅谈几点辩护技巧。
