随着社会经济的飞速发展以及信息技术的逐渐成熟,互联网已经成为了我们日常生活中不可或缺的一部分,在我们的衣食住行中扮演着重要角色。互联网给我们的生活带来便利的同时,也给我们的生活带来了一些麻烦。网络环境中的名誉侵权问题就是其主要问题之一。随着人们民主法制观念的增强以及网络技术的发达,人们更加注重对自己的隐私特别是名誉的保护。结合《侵权责任法》第36条中关于网络侵权的规定以及目前学术界的主要观点对网络环境中名誉侵权的责任认定和责任承担进行详细探讨。
With the rapid social and economic development and the gradual maturity of information technology, the Internet has become an indispensable part of our daily life and plays an important role in our basic necessities of life. While the Internet brings convenience to our lives, it also brings some troubles to our life. Reputation infringement in the network environment is one of the main problems. With the enhancement of people’s concept of democracy and legal system and the development of network technology, people pay more attention to the protection of their privacy, especially reputation. Combined with the provisions on network infringement in Article 36 of the Tort Liability Act and the current academic viewpoints, this chapter discusses in detail the liability affirmation and responsibility assumption of reputation infringement in the network environment.
