现代企业产权制度，最初是社会化大生产与资本主义私有制之间的矛盾与冲突的产物，其核心是不同于个人对财产的权利的企业法人产权。现代企业产权制度的制度潜力表现在权利主体分离化、权利内容股权化、权利客体证券化、所有权约束机制化、资本增殖社会化和制度化、公司经营透明化、资源配置市场化、资本占有社会化等方面，较好地体现了产权明晰化和社会化、经营权明晰化和社会化的统一。
