毒品犯罪现在越来越多,吸毒者很大一部分是青少年,受毒害很深。毒品的来源很大一部分又是毒贩子从国外走私进来。因此,打击毒品犯罪形势不容乐观。犯罪的定性准确,有利于维护刑法的权威。本文案例,公诉机关对其定性问题都有不同的观点,笔者直接接手本案,为被告人提供辩护,在此发表自己的观点,与学者商榷。 Drug crime is now more and more, a large part of drug abusers are young people, deeply poisoned.
