本文旨在研究如何运用国际投资法来解决中国境内的投资争端。在简要介绍国际投资法的基本结构之后,文章探讨了外国在华投资者以及中国在第三国境内的投资者可适用的国际法律规则。文章集中探讨中国在下列条约或体制中的义务,如《关于解决国家和他国国民之间投资争端公约》、《建立多边投资担保机构公约》、世界贸易组织/关贸总协定体制以及双边投资条约等,进而阐释中国在国际仲裁和保护外国投资者的其他国际标准方面的谨慎态度,以及当前中国为其在第三国的投资者寻求国际法保护的政策倾向。本文的结论是,随着中国对外投资的日益增加,中国的国际投资体制已经脱离了幼稚期,开始为外国在华投资者与本国在外国的投资者同时提供救济手段。
This article aims to study how to use international investment law to resolve investment disputes in China. After a brief introduction to the basic structure of international investment law, the article explores the applicable international legal rules for foreign investors in China and for Chinese investors in third countries. The article focuses on China’s obligations in the following treaties or institutions, such as the Convention for the Settlement of Investment Disputes between States and Foreign Nationals, the Convention for the Establishment of Multilateral Investment Guarantee Institutions, the WTO / GATT System and Bilateral Investment Treaties , Which explains China’s cautious attitude in international arbitration and other international standards for the protection of foreign investors and the current tendency of China to seek the protection of international law by its investors in third countries. The conclusion of this paper is that with the increase of China’s foreign investment, China’s international investment system has been out of its infancy and started to provide remedies to foreign investors in China and foreign investors in their own countries at the same time.
