当下已是各学科互相融通的时代,而概念作为思维的结晶,自应作为学科间相互交流的重要一环。概念在学科间的交流包括概念的输出与输入两个方面。就当代中国法学而言,概念的输出几乎没有,而概念的输入则颇为常见。但是许多概念的输入犯了“形式主义的谬误”,对概念采取了一种标签化的做法。其实,概念的输入需要一个正本清源的过程,要厘清概念的本来面目和待建理论的脉络,从而使二者有机结合、溶为一体。
The moment is the era of interdisciplinarity among different disciplines, and the concept, as the crystallization of thinking, should serve as an important part of interdisciplinary exchanges. The concept of interdisciplinary communication includes the concept of output and input in two aspects. In modern Chinese jurisprudence, there is almost no output of concepts, and the input of concepts is quite common. But many of the concepts were imported “for the fallacy of formalism” and adopted a label-based approach to concepts. In fact, the concept of input requires a clear source of the original process, to clarify the true nature of the concept and the context of the theory to be built, so that the two combine and dissolve into one.
