当前我国司法领域存在的主要问题是司法腐败 ,其根本原因不是司法人员的素质差和具体管理制度的缺陷 ,而是制度性的权力结构存在的缺陷 ,继而导致司法的腐败 ,即我国还没有真正实现在计划经济体制下形成的、以国家权利为本的司法制度 ,向与市场经济相适应的、以公民权利为本的现代司法制度的转型。实现这一转型 ,对“依法治国 ,建设社会主义法治国家”具有重要的意义。这将是一个较长期而艰难的历程。目前在观念上对政治体制改革的目标、方向和核心要明确 ,对司法、司法机关、司法权力等范畴的研究和认识要深化 ,对市场经济与计划经济具有性质不同的法律要求要多加关注 ,对法律承认和平等地维护多元利益主体的新观念要树立 ,并处理好学习外国经验与保持中国特色的关系问题 ,以及扭转“非此即彼”简单类比的思维模式 At present, the main problem existing in the judicial field in our country is the corruption of the judiciary.
