21世纪社会主体间合作和交流日益频繁,在国际交往中,区域经济日益一体化。在这一进程中,区域的治理和合作理论得到了长足的发展。目前,我国在区域合作中的跨行政区域交流中,带来的利益冲突、资源的整合、环境的治理等问题急需吸取国外区域合作的有益经验。现有的实践和理论研究表现,而区域治理表现为法治化的治理,其中区域立法体制、机制的建立是重要的环节。在立法中,应重视立法技术的完善,打破区域内主体间的利益冲突,建立民主、协商的沟通机制,这是实现区域间有效治理的关键问题。
In the 21st century, the cooperation and exchange between social subjects are increasingly frequent. In international exchanges, the regional economy is becoming more and more integrated. In this process, the theory of governance and cooperation in the region has made great strides. At present, the problems of conflicts of interest, integration of resources and environmental governance brought by our country in cross-administration regional exchanges in regional cooperation urgently need to draw on the beneficial experience of regional cooperation in other countries. The existing practice and theory show the performance, while the regional governance shows the rule of law, of which the regional legislative system and mechanism are important links. In legislation, attention should be paid to the improvement of legislative techniques, breaking the conflicts of interest among subjects in the region and establishing a democratic and consultative communication mechanism, which is the key issue for achieving effective governance among regions.
