我国修改后的刑事诉讼法进一步强调了物证在刑事诉讼中的核心地位,其精神实质是要确立物证本位的侦查价值观。然而,我国长期受纠问式诉讼观念的影响,刑讯逼供、缘供取证现象屡见不鲜,物证本位侦查价值观并未在实践中真正确立起来。转变传统的侦查价值观,要提高侦查队伍素质,转变诉讼价值观念,强化证据意识,推进刑事科学技术发展,提升侦查破案的技术含量,加强对侦查过程的司法审查力度。
The revised Criminal Procedure Law of our country further emphasizes the core position of material evidence in criminal proceedings. Its essence is to establish the investigative values of material evidence-based position. However, the long-term influence of China’s concept of litigation, the phenomenon of extorting a confession by torture, the phenomenon of forensic evidence, are rare, and the value of the evidence-based investigation has not really been established in practice. Change the traditional value of investigation, to improve the quality of the investigation team, change litigation values, strengthen the awareness of evidence, promote the development of criminal science and technology, enhance the technical content of detection and detection, and strengthen the judicial review of the investigation process.
