近代民事立法有三个法律文本—《大清民律草案》、《民国民律草案》《中华民国民法》,通过对三个文本关于民事行为能力和女性财产权的规定进行对比,研究近代民事立法中女性地位的变迁,并进一步分析原因。值得注意的是,这种改变说到底只是法律条文的变化,我们也应该关注实然状态。着眼于现代社会,我们仍然能看到一些类似于天价彩礼、用工单位性别歧视等现象,所以提高女性地位任重而道远。
There are three legal texts in modern civil legislation: the Draft of Qing Civilica Law, the Draft Civil Law of Republic of China and the Civil Law of Republic of China. By comparing the three texts, Changes in the status of women, and further analysis of the reasons.
