The Patent Law of the People’s Republic of China has been promulgated and implemented for 10 years, and patent protection of drugs was started in January 1994. This is an important measure for China’s development of a socialist market economy. As China is about to resume GATT status and market economy development, intellectual property rights will become an important part of corporate interests. However, the Chinese medicine industry does not fully understand the role of knowledge, technology, and property rights in the development of enterprises. According to the “Decision of the State Council on Further Strengthening the Protection of Intellectual Property Rights,” the “Two Systems of Forming Administrative Management and Judicial Protection in China” has been put forward, and the spirit of the parallel operation system has been strengthened to enhance protection and the Patent Law.
